This privacy policy (“Privacy Policy”) governs the collection, handling, use, disclosure, transfer or otherwise processing of personal data or sensitive personal data by Bengaluru Prayana, a registered brand of Ms Raksha Nagaraj Prasad (“we”, “us” or “Company”). The Company is the sole owner and publisher of the website https://bengaluruprayana.com (“Platform”). References to “BengaluruPrayana.com”, “bengaluruprayana.com”, “Bengaluru Prayana”, “BengaluruPrayana”, “bengaluruprayana”, “we”, “our”, “us”, “our website”, “site”, and “this website” mean BengaluruPrayana.com, i.e., the Platform.

When the users of the services, including employees, customers, candidates, clients and vendors of the Platform (jointly and severally referred to as “you” or “Users” in this Privacy Policy), use the Platform, avail our services or interact with us (collectively “Interactions”), we may collect some personal information from you (as detailed below). We are committed to protecting the security of your personal information and safeguarding your privacy, and this Privacy Policy sets out the manner in which we collect personal information from you and use this personal information that we have collected (as detailed below) or received about you. We process your personal data to deliver the service to you. We may also process your personal data in order to comply with our legal obligations as explained below or due to our legitimate interests. COMPLIANCES UNDER PRIVACY POLICY

This Privacy Policy is published in compliance with the provisions of the Digital Personal Data Protection Act 2023, read with applicable rules and regulations. We are implementing full operational compliance in phases. Complete compliance with all technical and organisational requirements will be achieved by May 13, 2027, as per the regulatory timeline.

We continuously monitor updates from the Data Protection Board of India and update our practices accordingly. Any significant changes to this Privacy Policy will be notified to you with 30 days’ advance notice.

PERSONAL INFORMATION WE COLLECT

Our services may require us to know about you and your specific requirements so that we can best meet your needs. When you access our services or interact with us via the Platform (including chat windows, emails, telephone calls, or other correspondence), we may ask you to provide certain information that personally identifies you or could be used to personally identify you. Accordingly, where required under applicable laws, the Company will process the Personal Data on the basis of the express consent of the Users, as evidenced by their acceptance of this Privacy Policy, for the specific purposes set out below. You hereby consent to the collection of such information by the Company. Without prejudice to the generality of the above, information collected by us from you may include the following details in the following circumstances:

  1. A User is required to provide the following information, which such User recognises and expressly acknowledges is personal data, such as name, email address, phone number, Aadhaar card copy and number, etc for booking the walks/ events hosted by us, receiving newsletters and for communications regarding the walk and events through WhatsApp and emails. Other information may be requested in the future, including the User’s willingness to receive promotional offers from the Company (which is optional), to help the Company customise the Platform and deliver personalised information to the User.
  2. Any comments published by you on the Platform may also be collected and stored.
  3. Any payment information, such as UPI details, payment screenshots, etc., is retained to retain details of the booking made by you.
  4. Information about your IP address and the browser you’re using, along with cookies.
  5. The Company collects information about the User while providing services.
  6. Media files and other documents shared by you for marketing and social media.
  7. Other information that you voluntarily choose to obtain from us or submit to us.

The information collected from you by the Company may constitute ‘personal information’ or ‘sensitive personal data or information’ (“Personal Data”). 

You hereby authorise the Company to use, collect and disclose information that is freely available in the public domain without your consent. The Company does not collect information about Platform visitors from other sources, such as public records or bodies, or private organisations. The collection, use, storage and disclosure of which each User must agree to under the Terms and Conditions in order for the Company to effectively render the services.

You may choose not to provide consent for the collection of Personal Data by us. In such an event, we are not obligated to provide you with the services. If you wish to withdraw the consent you previously provided for the processing of your Personal Data, you may send a written request to our Data Protection Officer (contact details below). We will have the option to stop providing services in such a case. We will retain your information for as long as you are availing services from the Company. We shall not retain such information for longer than is required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force. After a period of time, your data may be anonymised and aggregated, and then held by us as long as necessary to provide our services effectively, but our use of the anonymised data will be solely for analytical purposes.

AADHAAR DATA HANDLING

COLLECTION AND PURPOSE

We collect Aadhaar card copies and numbers only when mandatory for submission to the Army/Military authorities for access to restricted heritage sites and locations under their control. We do not collect or store any biometric information (fingerprints, iris scans); we only collect and store demographic information from physical/scanned copies. Separate explicit consent is required before collecting Aadhaar data, and for participants under 18 years, parental/guardian consent is mandatory.

SECURITY AND STORAGE

All Aadhaar documents (physical copies and digital scans) are stored in password-protected, encrypted folders separate from all other data. Only authorised personnel can access these files. We maintain a log of when and why Aadhaar documents are accessed. Physical copies are kept in a locked storage area. Aadhaar data is never published, displayed publicly, shared on social media/WhatsApp groups, emailed to anyone other than government authorities, used for marketing, or combined with any other databases. It is shared only with the concerned government authorities as legally required for the specific walk/event.

DELETION AND YOUR RIGHTS

Aadhaar documents are submitted to concerned authorities within 24-48 hours of receipt and permanently deleted from ALL our systems (including digital files, emails, backups, and physical documents) within 7 days of submission, with a maximum retention period of 90 days only if legally required. You may request confirmation of whether we hold your Aadhaar information, request immediate deletion after submission to authorities, or withdraw consent for future events. In the event of any Aadhaar data breach, we will notify the UIDAI, the Data Protection Board, and all affected individuals within 24 hours. If you do not wish to provide Aadhaar information, you may participate in walks/events that do not require restricted-area access, though on Army-controlled sites, Aadhaar submission is typically mandatory. If you suspect misuse, contact our Data Protection Officer immediately or file a complaint with UIDAI at help@uidai.gov.in or call 1947.

PURPOSE AND USE OF PERSONAL DATA

The Company reserves the right to use information provided by or about the User for the following purposes: 

  1. Contacting Users for offering new products or services.
  2. Contacting Users for taking product and service feedback.
  3. Analysing information for commercial use.
  4. To enable you to avail services and facilitate bookings for services.
  5. To process your payment, facilitate billing and issue invoices, as applicable.
  6. To communicate with you and to respond to your requests.
  7. To communicate with you on general information and newsletters.
  8. To provide you with customer service and support.
  9. For marketing, social media posts, and promotions.
  10. To help keep our Platform safe and secure, and to improve the Platform.
  11. Resetting passwords to your accounts.
  12. To subscribe to our communications, if subscribed.
  13. We use information to analyse trends, administer the Platform and track user activities on the Platform if you have consented to the same.
  14. We will create anonymous data records from Personal Data by excluding information (such as your name) that makes the data personally identifiable to you. We use such Anonymous Data records to analyse request and usage patterns so that we may enhance the content of the services and improve Platform navigation.
  15. Use information as otherwise permitted by law.

If you have voluntarily provided your Personal Information to the Company for any of the purposes stated above, you hereby consent to such collection and use of such information by the Company and consent and grant right to the Company to contact you on your telephone/mobile number(s) for any purpose even if such telephone/mobile number is registered with the Do Not Call registry (“DNC Registry”). 

Additionally, if you request a password reset, your IP address will be included in the password reset email.

WhatsApp phone numbers would be used only for group announcements and walk coordination, and shall not be shared with any third party. If anyone in the group sends you unnecessary or inappropriate messages outside of the group, please notify one of the admins. We will take the necessary actions.

Emails are used to send newsletters and walk updates; you can unsubscribe at any time.

DATA RETENTION

We retain your personal data only for as long as necessary. Please note that we have the following data retention periods:

  • If you leave a comment, the comment and its metadata are retained indefinitely, until deleted. This allows us to automatically recognise and approve any follow-up comments, rather than holding them in a moderation queue. Visitor comments may be checked through an automated spam detection service.
  • For Users who register on our Platform (if any), we also store the personal information they provide in their user profiles. All users can view, edit, or delete their personal information at any time (except their username). Website administrators can also see and edit that information. All accounts are retained unless the user requests their deletion.
  • All data related to walks, events and groups is retained till the walk is completed. However, unless you request deletion, such data may be retained for legal reasons.
  • Your Aadhaar documents are deleted immediately after submission to the authorities and are retained for a maximum of 90 days.
  • Payment screenshots will be deleted within 30 days after the walk completion.
  • We may retain data for legal and compliance purposes, in accordance with the timelines required by law.

Article/Blog Posts Comments

When visitors leave comments on the Platform, we collect the data shown in the comments form, as well as the visitor’s IP address and browser user agent string, to help with spam detection.

An anonymised string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here:https://automattic.com/privacy/. After your comment is approved, your profile picture will be visible to the public alongside your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

SHARING OF PERSONAL DATA

The Company maintains a strict “No-Spam” policy. Personal Data provided by you, or that we may obtain automatically by your use of the Platform, is not and will not be sold, rented, or shared by us with any third party without your prior consent. We disclose your Personal Data as described below.

Storage of Personal Data

Your personal data is stored and processed on servers located in India and other countries. Our hosting provider is Hostinger, and data may be transferred to and stored in countries outside India.

We ensure that:

  • All service providers maintain adequate security standards
  • We do not transfer data to countries restricted by the Government of India
  • Your data is protected with the same level of security regardless of location
  • We monitor government notifications regarding restricted countries and will update our practices accordingly

By using our services, you consent to this cross-border transfer of your data.

Third Party Service Providers

We will share your Personal Data with third-party companies and individuals that perform Services on our behalf to help us provide the Platform to you, and you hereby consent to such sharing of your Personal Data.

Further, this Platform is affiliated with Monumetric (dba for The Blogger Network, LLC) to place advertising on the Platform, and Monumetric will collect and use specific data for advertising purposes. For hosting and data storage, we use Hostinger.  Third-party service providers acting on our behalf are only provided with such Personal Data reasonably required to provide the particular service for which they are retained. These providers have their own data practices beyond our control. You are requested to review the privacy policies of third-party service providers for more information about the use of your data.

Third Party Links

This Privacy Policy applies only to services that are owned and operated by the Company. The Company is not responsible or liable for any breach of information provided by the Users. 

Articles on the Platform may include embedded content (e.g., videos, images, articles). Embedded content from other websites behaves as if the visitor had visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

The Company does not make any representations concerning the privacy practices or policies of such third parties or terms of use of such websites, nor does the Company guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, messages or other materials available on these websites accessed from the Platform of the ‘Users’. From time to time, we may share your Personal Data so that it is readable only by the intended advertiser to serve you relevant information and marketing messages on that advertising platform. ·            Right to nominate: They have the right to nominate any individual who will exercise their rights set out under this Privacy Policy in case of their death or incapacity (i.e., inability to exercise statutory rights granted to a data principal/ user due to unsoundness of mind or infirmity of body).

·            Right of grievance redressal: They have the right to contact the Company about how their Personal Data is processed, the Company’s obligations in relation to such Personal Data and/or with regard to their rights in relation to their Personal Data. 

Further, where the Company processes personal data based on consent, the Users can exercise the following additional rights:

·            Right to access information about personal data: They have the right to obtain a summary of their personal data and the processing the Company has undertaken in relation to the same. They also have the right to obtain from the Company (a) the identities of the parties with whom the Company has shared such personal data along with the description of the Personal Data shared; and (b) any other information as may be required to be provided under applicable law, unless the Company has shared such Personal Data with another person who is authorised by law to obtain such personal data for the purpose of prevention or detection or investigation of offences or cyber incidents, or for prosecution or punishment of offences, as applicable.

·            Right to correct and erase personal data: They have the right to correct, complete, update and/or require erasure of their Personal Data. However, the Company will not be able to comply with an erasure request if it must retain such information for the purpose for which it was collected or for compliance with legal requirements.

STATEMENT APPLICABLE FOR CASUAL VISITORS

No sensitive personal data or information is automatically collected by the Company from casual visitors to this Platform who are merely perusing it. 

Nevertheless, certain provisions of this Privacy Policy apply to even casual visitors, and such visitors are also required to read and understand the privacy statements set out herein; failing which, they must leave this Platform immediately. 

If you, as a casual visitor, have inadvertently browsed any other page of this Platform prior to agreeing to having read the Privacy Policy and Terms and Conditions, and you do not agree with the manner in which such information is obtained, collected, processed, stored, used, disclosed or retained, merely quitting this Platform should ordinarily clear all their temporary cookies/ cache. 

All visitors, however, are encouraged to use the “clear cookies” functionality of their browsers to ensure such clearing/deletion, as the Company cannot guarantee, predict, or provide for the behaviour of the equipment of all visitors to the Platform.

CONFIDENTIALITY AND SECURITY

Your Personal Data is maintained by the Company in electronic form on its equipment and on the equipment of its employees. Such information may also be converted to physical form from time to time. The Company takes all necessary precautions to protect your Personal Data both online and offline and implements reasonable security practices and measures, including managerial, technical, operational, and physical security controls commensurate with the information being collected and the nature of the Company’s business.

The Company makes all User information accessible to its employees, agents, or partners, and to third parties, only on a need-to-know basis, and binds only its employees to strict confidentiality obligations. 

Part of the Company’s functionality is assisting clients in maintaining and organising such information, and enabling Users to access the Personal Data. The Company may, therefore, retain and submit all such records to the appropriate authorities, or to clients who request access to such information.

Notwithstanding the above, the Company is not responsible for the confidentiality, security or distribution of your Personal Data by our partners and third parties outside the scope of our agreement with such partners and third parties. Further, the Company shall not be responsible for any breach of security or for any actions of any third parties or events that are beyond the reasonable control of the Company including but not limited to, acts of government, computer hacking, unauthorised access to computer data and storage device, computer crashes, breach of security and encryption, poor quality of Internet service or telephone service of the User etc.

DATA BREACH NOTIFICATION

In the event of any personal data breach (unauthorised access, loss, or disclosure of your data), we will:

  1. Report the breach to the Data Protection Board of India within 72 hours of becoming aware of it.
  2. Notify you directly about the breach via email or phone, including details of what happened, what data was affected, and steps you should take to protect yourself.
  3. Take immediate action to prevent further breaches and secure your data.

We maintain detailed records of all data breaches and our responses to them.

LIMITATION OF LIABILITY

The Company specifically disclaims any liability with regard to the services and any actions resulting from your participation in any services, and you agree that you waive any claims against the Company relating to the same, and to the extent such waiver may be ineffective, you agree to release any claims against the Company relating to the same. 

If your Personal Data changes, you may correct, delete inaccuracies, or amend information by intimating such change through an email to bengaluruprayana@gmail.com. We will make all efforts to implement the requested changes in our then-active databases as soon as reasonably practicable. If you provide any information that is untrue, inaccurate, out of date or incomplete (or becomes untrue, inaccurate, out of date or incomplete), or the Company has reasonable grounds to suspect that the information provided by you is untrue, inaccurate, out of date or incomplete, the Company may, at its sole discretion, discontinue the provision of the services to you. 

CHANGE TO PRIVACY POLICY

We reserve the right to update this Privacy Policy at any time for any reason, with or without advance notice. An updated policy shall be uploaded on the Platform and will be effective on the day it is posted. In the event there are significant changes to this Privacy Policy, we will notify you by posting a notice of change on the Platform. Any material changes to this Privacy Policy will be effective upon 30 (thirty) calendar days following our posting of notice of the changes on our Platform. These changes will be effective immediately for new Users of our Platform.

If a User uses the Services or accesses the Platform after a notice of changes has been sent to such User or published on the Platform, such User hereby provides his/her/its consent to the changed terms.

SIGNIFICANT DATA FIDUCIARY DESIGNATION

As of the date of this Privacy Policy, Bengaluru Prayana has not been designated as a Significant Data Fiduciary by the Government of India.

CHILDREN’S PRIVACY AND PARENTAL CONSENT

Participants for our events are 10+ years old. All children under the age of 18 [Legal 4] years must be accompanied by their guardians.

For participants under 18 years:

  • We require verifiable parental or guardian consent before collecting any personal data from children.
  • Parents/guardians must complete the booking and consent process on behalf of the child.
  • We collect only essential information necessary for the walk/event participation.
  • Parents/guardians can request access to, correction of, or deletion of their child’s data at any time.

The Company, though, may be suitable for a minor User; however, the recommended age for use of the Platform is 18+. The Company strongly encourages parents and guardians to supervise their minor children’s online activities and to consider using parental control tools available from online services and software manufacturers to help create a child-friendly online environment. We would also prefer and encourage the parents or guardians to use the Platform on behalf of their minor children. These tools can also prevent minors from disclosing their name, address, and other personally identifiable information online without parental permission. Although the Platform and services can be used by minors under the oversight of their respective caretakers/guardians, the Company respects the privacy of minors who may inadvertently use the Platform. If we discover that we have collected data from a child under 18 without proper parental consent, we will delete such information immediately.
